Website Terms of Use & Conditions

Terms of Use

Welcome to the Herodiver website (hereinafter: "the Website"). Use of this website is subject to the terms and conditions set forth below ("Terms of Use"). Please read them carefully before using the website. Use of the website constitutes full and irrevocable acceptance of all terms detailed in this document. If you do not agree to these terms, please refrain from using the website.

1. General

1.1 The website is operated and managed by HERODIVER, Licensed Dealer (E.M.) 305489295 (hereinafter: "the Company"). 1.2 The website is used to present information in the field of diving, marketing and selling diving equipment and related products, contacting the Company, and—as offered on the website from time to time—registering for courses, workshops, training, and activities in the diving field, including a drysuit operation course. 1.3 It is clarified that providing details on the website, sending an inquiry, filling out a contact form, or requesting information does not constitute registration for a course, reservation of a spot, confirmation of participation, a commitment to hold any activity, or a binding engagement of any kind. Any participation in a course, training, or activity, if offered in the future, will be subject to the provision of additional details, suitability assessment, express approval by the business, and dedicated separate terms as provided to the interested party, if and as relevant. 1.4 Use of the website, its content, and the products/services appearing therein indicates the user's consent to these terms and their commitment to act in accordance with them.

2. Website Accessibility

2.1 The website operates in accordance with the provisions of Israeli Standard 5568 for Web Content Accessibility and subject to the provisions of the Equal Rights for Persons with Disabilities Law, 1998. 2.2 The website includes an accessibility component that allows for various adjustments such as changing text size, color contrast, marking links, keyboard navigation, and more. 2.3 Regarding physical accessibility for in-person training, these may take place in locations that are not fully accessible. In such cases, and subject to prior inquiry, the Company will examine the possibility of providing a reasonable solution as far as possible. 2.4 The Company makes ongoing efforts to improve accessibility. If you encounter any difficulties, please contact us via the "Contact Us" form or by email: info@herodiver.com.

3. Use of the Website

3.1 You may use the website solely for lawful purposes and in accordance with the Terms of Use. 3.2 The user undertakes to refrain from the following:

  • Using content for commercial purposes without prior written approval from the Company.

  • Copying, distributing, publishing, or broadcasting content without permission.

  • Interfering with the activity of the website or the servers operating it.

  • Using the website in a manner that may infringe upon the privacy of other users. 3.3 The Company reserves the right to prevent access or close a user account that has violated these terms.

3.4 Courses and Training

A. To the extent that the Company offers registration for courses, training, or activities, the Company may determine dedicated and separate terms at its sole discretion, including regarding threshold conditions, payment, cancellation, liability, safety, fitness, and participation, which will be provided to the user at the relevant time. B. Any information appearing on the website regarding courses, training, or potential activities, including descriptions, explanations, images, videos, Q&A, or other information, is intended for general information purposes only and does not constitute a commitment to availability, actual occurrence, timing, scope, content, price, participation conditions, or any other detail. C. Registration is subject to the provision of full, correct, and accurate details. Furthermore, registration for a course and/or training will be considered confirmed only after receipt of payment confirmation and registration confirmation. D. The Company may refuse to approve or cancel registration for a training and/or course if incorrect details were provided, if there is a concern of misleading or improper use, or if there is a legal, regulatory, operational, safety, or other risk.

3.5 Purchase of Equipment on the Website

A. The website allows for the online purchase of products, including diving equipment, accessories, and related products, as displayed on the website from time to time. Placing an order on the website is subject to these Terms of Use, as well as the website's shipping, returns, and transaction cancellation policies, which form an integral part thereof. B. A user who is legally competent to perform binding legal acts, including those over the age of 18 or those who have received lawful authorization from a guardian or the owner of the payment method used for the order, may perform a purchase on the website. C. To place an order, the user will be required to provide correct, full, and accurate details, including identification, contact, delivery, and payment details, as applicable. The user is fully responsible for the accuracy of the details provided. D. Payment for purchases is made via an external clearing provider and/or other payment methods. The processing of payment is subject to the terms of the clearing provider, credit card company, or issuer. Receipt of order details does not, in itself, constitute final confirmation of the transaction. E. The display of a product on the website does not constitute a binding offer by the Company, but rather an invitation to submit offers to purchase. A transaction is considered finalized only after the Company has actually confirmed the order at its discretion. F. The Company may update or remove products and prices at any time without prior notice. In the event of a clerical error or technical disruption regarding price or description, the Company shall be entitled to cancel the order or contact the user for instructions. G. Product images are for illustration purposes only. Differences may exist between the actual product and its appearance on the website. H. The user is responsible for examining the suitability of the product for their needs, level of training, and manufacturer instructions, if necessary through a suitable professional.

4. Warranty and Limitation of Liability

4.1 The content on the website is provided "As Is," and the Company is not responsible for its accuracy, timeliness, or completeness. 4.2 To the extent permitted by law, the Company shall not be liable for indirect, consequential, or special damages arising from the use of the website or reliance on its content. 4.3 It is clarified that the content, recommendations, and descriptions on the website are for general information only and do not constitute professional, safety, medical, or instructional advice, and are not a substitute for qualified training or manufacturer instructions. 4.4 The fitting of diving equipment to a user requires individual examination and professional guidance. Do not rely solely on the website content for the selection or use of equipment.

5. Links to External Websites

5.1 The website may include links to external websites. 5.2 The Company has no control over the content of these sites and is not responsible for the information or services provided therein.

6. Intellectual Property

6.1 All rights to the website and its content belong to the Company or are used by it under lawful permission. 6.2 Users may not copy, reproduce, publish, or make commercial use of the website content without prior written approval.

7. Privacy

The Company respects the privacy of users and operates according to an updated Privacy Policy (including Amendment 13) attached to the website in accordance with the law.

8. Changes to the Terms of Use

8.1 The Company reserves the right to update the Terms of Use from time to time at its sole discretion. 8.2 Any change will take effect immediately upon its publication on the website.

9. Jurisdiction

9.1 These terms are subject exclusively to the laws of the State of Israel. 9.2 The exclusive jurisdiction for any matter arising from these terms shall be vested in the competent courts in the Southern District (Be'er Sheva).
