HERODIVER – Warranty and Limitation of Liability Regulations for the Use of Diving Equipment

1. Purpose and General Agreement

This document regulates the warranty conditions, limitation of liability and disclaimer of the importer/supplier HERODIVER in relation to the following products (hereinafter: 'the equipment'): regulators and breathing systems, diving balances (BCD/Wing), dry and semi-dry suits, dive computers, masks, fins, valves, tubing, accessories and other products marketed by HERODIVER.

2. Risk warning and risk assumption

Underwater diving is an activity with inherent risk that may cause serious injury or even death. The equipment is not a substitute for training, physical fitness, dive planning or safety procedures. The user declares that he is qualified, has been trained to use the equipment in accordance with the manufacturer's instructions, and that he will use it in accordance with the law, accepted safety standards and procedures.

3. Definitions 'Proper Use' and 'Standard Maintenance'

Proper Use – Use in accordance with the manufacturer's operating/safety instructions and the permitted environmental conditions. Standard Maintenance – Cleaning, storage, periodic testing and servicing by an authorized laboratory/technician in accordance with the manufacturer's instructions.

4. Limited Warranty of the Importer

The warranty is limited to manufacturing defects only. The customer's exclusive remedy is repair or replacement. The warranty is not transferable and does not apply to products purchased from an unauthorized source.

5. Exceptions – Cases where there is no warranty

The warranty does not apply to improper use, lack of maintenance, natural wear and tear, physical damage, structural modification, connection of incompatible components, poor storage, competitive use, removal of serial number or cosmetic damage only.

6. Unique conditions by equipment category

Regulators: Warranty subject to service by an authorized technician. Balances: Warranty for private use up to 5 years. Dry suits: 4-year warranty on non-perishable materials. Computers: Warranty for manufacturing defects only.

7. Limitation of liability and indirect damages

HERODIVER shall not be liable for indirect, consequential damages or loss of profit. The foregoing shall not derogate from the rights set forth in the law.

8. Safety, standards and applicable law

The use of the equipment is subject to standards EN250, EN1809 and EN14225-2 and the procedures of the Diving Authority in Israel. The applicable law is Israeli law.

9. Miscellaneous

The document constitutes the complete regulations regarding liability. Changes will only be made in writing and in advance.
